Some Ombudsman Reforms Amendment Sponsor: u/SrijitDas2010 Co-sponsor:u/Bob-The15th Section I. Purpose and Intent The purpose of this amendment is to clarify the powers of the Ombudsman regarding access to party, coalition, organization, and related servers within TeenGov. This amendment recognizes that the currently outlined powers regarding server access may create loopholes, uncertainty, or abuse regarding what level of access an Ombudsman is legally entitled to during an investigation. This amendment also seeks to ensure that investigations may not be obstructed through partial access, hidden channels, or selective permissions while simultaneously preventing unnecessary surveillance or unrestricted access to unrelated organizations without cause. Section II. Definitions i) The Ombudsman shall refer to the official investigative officer of the community. ii) Directly related server shall be defined as defined by the Separation of Unrelated Servers Amendment. iii) Full server access shall refer to access to all channels, categories, threads, logs, and areas within a server. Section III. Articles Article I i) The Ombudsman shall only gain access to a related server under the circumstance that an official investigation is being conducted regarding said server. ii) The Ombudsman may not request or retain access to a related server without an active investigation involving them. iii) Once the investigation concludes, the Ombudsman loses access to the related server if such access was granted solely for the purpose of the investigation and was not already possessed prior to the investigation. Article II i) Server leadership, ownership, or mods may not restrict the Ombudsman to selective channels, categories, or limited visibility during an active investigation. ii) Hidden channels, staff chats, archive channels, or restricted categories shall be included within required access if it is deemed necessary for the investigation by the Ombudsman. iii) Failure to provide a full server access, even after being requested by the Ombudsman, during an official investigation may be considered obstruction of an investigation. iv) The Ombudsman may not use information gathered from the investigation for political or personal reasons. Article III i) The Ombudsman may not publicly release screenshots, logs, or other information gathered from the investigations unless such information directly proves a violation of TeenGov laws. ii) Personal information unrelated to TeenGov activity shall remain protected. Section IV. Effectiveness This amendment shall take effect immediately upon passage. ">Edits">Edits* Updated Article I(III).
