Definitions:
Population Crisis: an election cycle where all vacancies are unable to be filled.
D’Hondt’s method: The D'Hondt method is a mathematical formula used in proportional representation systems to allocate legislative seats among political parties. It works by dividing each party’s total vote count by a series of sequential integers (1, 2, 3, 4, etc.) and assigning seats to the highest resulting quotients until all available seats are filled.
Article 1, Council:
(A) The Council will have 12 members
(i) 3 of the seats will be contested by independent candidates
(ii) The remaining 9 seats will be contested by parties as detailed in Article 4
(iii) The Council Size Referendum will be abolished until the number of registered citizens breaches 100 after which numbers between and including 11 and 27 would be given as options
(iv) The speaker of the council will exist according to the existing relevant acts
(B) The Prime Minister will be elected by all the Council members in a vote
(i) The Prime Minister acts as the head of government
(ii) The Prime Minister appoints the cabinet (ministers).
President can recall ministers appointed by the PM
(iii) The Prime Minister acts as advisor to the President who is the head of state
(iv) The Prime Minister may take an additional ministry in case of population crisis
(v) The Prime Minister may declare state of emergency with Presidential assent
(vi) The Prime Minister requires the support of the majority of the council and can be removed through a vote-of-no-confidence getting a simple majority to remove the Prime Minister at any point of time. The Prime Minister will still remain a council member.
(C) The council may be dissolved through a referendum initiated by the President. In case a simple majority of voters vote for dissolution, the council shall be dissolved. If a simple majority votes against dissolution, the President shall be removed.
Article 2 Senate:
(A) The Senate consists of 5 members excluding the vice president
(i) All Senators will be elected through STAR voting.
(ii) The Vice President may only vote in case of a tie
(iv) Senators will have their terms begin and expire with Council Members.
(B) Any bill or amendment must be passed by both the council and senate to become law.
(C) In state of emergency the Senate can pass any bill without it being passed by Council with Presidential assent.
Article 3 President and Vice President:
(A) The President is the head of State
(i) The President can veto any bill or amendment and prevent it from passing. This veto can be overridden by an 80% vote of a joint session of council and senate
(ii) The President must not be a member of the council or senate
(iii) The Vice President must not be a member of council
(B) The President may dissolve the council by the procedure mentioned in Article 1
(C) The President may not initiate the imposition of a state of Emergency without Prime Ministerial request
(D) The President is the supreme commander of the armed forces
(E) The President may put up bills for referendum if they fail in one house but pass in another. This is not mandatory.
(F) The President has the power to assume control of a province with assent of a supermajority in both houses in case of activity threatening peace and order.
(G) The Vice President may take on ministerial responsibility in times of Population Crisis
(H) The President and Vice President may sign ECOs as under the Executive Chicanery Amendment
(I) This bill shall not be interpreted as legislation to change anything about the President’s electoral mechanism
Article 4 Elections and Proportional Representation:
(A) Each voter has two votes: A vote for a party (and by extension candidates of the party) and a vote for an independent candidate
(i) Seats in the council are distributed proportional to the number of votes received by each party.
(ii) Proportions will be calculated by The D’Hondt method
(iii) If less than 3 independents take part in the election, the independent seats unable to be filled will be converted into a party seat.
(B) Party seats are to be filled in order of candidates in a list given by the party
(i) If a party does not have enough members to fill as many seats as they won in proportionality, they will receive 3 days to recruit new members. If they fail to recruit a new member, the seat will go to the next party.
(ii) The Party list must be chosen by an internal transparent election, the results of which must be shown publicly.
(iii) Party members may opt out of the list if they wish.
(iv) Any vacancy at a later stage will trigger a simple by-election where members of parties and independents can all participate as candidates. The candidate with the most votes wins.
(C) After elections, in case a council member occupying a party seat wishes to leave the party, they must have two-thirds of the party's council members leave the party. This doesn't apply during party dissolutions.
(i) The President has the power to make exemptions in this matter, however this must be approved by the Chief Justice
Article 5: Council voting
(i) Everyone voting for the Council must vote for one single party. D’Hondt’s method will be applied after elections to fill the 9 party seats and distribute them among the parties
(ii) Everyone voting for the Council must also vote for one independent candidate. The 3 seats which are contested for by independent candidates will be won by the 3 candidates having the highest vote count. When necessary, runoff elections may be used for breaking ties.
Article 6: STAR voting
(i) Everyone voting for the Senate will receive a ballot asking them to score all candidates from 1 to 5
(ii) The formula for the runoff is (Top \[number of candidates of the legislature\] + the top 50% of the candidates left off)
Article 7: Conflicting Legislation and Reliance
A) Any conflicting passed bills that focus on the topic of this bill or have clauses talking on the topics of this bill shall be repealed at the passing of this bill.
B) Any pieces of legislation that previously were dependent on the Council, or any other relevant terms are furthermore dependent on the parameters set in this bill.
